Love without sex is dry. Sex without love is cold.
Sex is just one of many ways to express intimate relating.

California is a common law marriage state.
Your relationship agreement has legally binding clauses.
Changing your last name is a HUGE indication of your intent to be married at common law.

Both of you should consult a lawyer to create a relationship agreement that operates as a prenuptial, and properly allocates income, assets, personal property, real property, sweat equity, household duties, etc...

Your other document could be titled an "understanding of preferences."

One who is firstly a master of self should cover all essential living expenses, as though he lived alone -- since he would have to pay them anyway. Also, such a master should ensure that his partner has a source of income that is saved in a separate financial account, in the unfortunate event of his separation, illness, or death.

In your case, that might mean putting your real property and rental income into a Nevada or Texas LLC, to minimize state income or capital gains tax; protect it from equitable diminution as said above; and prevent a tenant lawsuit that could attack the relationship's house and family assets.
